The executive order, released on Wednesday, leverages the authority of Section 232 of the Trade Expansion Act. It targets cutting-edge devices such as the Nvidia H200 and AMD MI325X, following a conclusion by the administration that reliance on foreign chips poses a national security threat.
While the headline figure is high, the administration has adopted a strategic approach to implementation. Recognizing the importance of the domestic AI sector, the order grants broad exemptions. Chips imported for use in U.S. data centers, startups, and public sector applications are not subject to the tariff. This ensures that the costs of innovation within the United States do not spike unexpectedly.
The policy includes a complex logistical requirement aimed at China. Chips manufactured in Taiwan for Chinese clients must now detour through the United States for third-party testing. It is during this entry into the U.S. that the 25% tariff is applied. This mechanism effectively taxes the Chinese market for using these advanced chips, bypassing direct export tax restrictions.
The White House argues that this action is necessary because the U.S. currently manufactures only about 10% of the chips it needs. This dependency is viewed as a “significant economic risk.” The tariffs are intended to serve as an incentive for manufacturers to shift their operations to U.S. soil, thereby securing the supply chain against future geopolitical shocks.
The market reaction was relatively mild, with shares of Nvidia and AMD trading slightly lower. The administration has indicated that this is a starting point, with the Commerce Secretary holding the discretion to adjust exemptions. The fact sheet also suggests that broader tariffs on semiconductor imports could be on the horizon if domestic manufacturing targets are not met.
